Our General Terms and Conditions apply to all our surf classes, camps and training courses in Biarritz.

1. Enrollment

To enroll in a class, camp or training course with Hastea Surf School, the customer should use the registration form. In the case of a minor (under 18), this form must be filled in by one of his/her parents or his/her legal representative. Otherwise, it must be duly completed by the interested party. By enrolling in one of our classes, camps or training courses, the customer acknowledges and agrees to the rules stated in the present document.

2. Payment & Payment Terms

At registration time, a retainer equal to 10% of the total amount due must be paid for the registration to be validated. Payments can be made by credit card (via our website), by personal check (from a French bank only) or in cash (on site). The customer has to pay the remaining balance on the day of his/her first class. If the customer cancels between 30 days and 15 days before the day of his/her first class, he/she will lose the retainer.

3. Cancellation by Hastea Surf School

In case of adverse weather conditions (no waves, dangerous waters, pollution…), the customer will be informed by phone as soon as possible. He/She will get a credit equivalent to the amount paid for the activity originally booked. The credit can be used for a later booking or reimbursed upon request.
No additional compensation will be paid.

4. Cancellation by the customer

If for whatever reason, the customer is unable to attend as planned, cancellation will be subject to the following conditions:
– If the customer cancels more than 30 days before the day of his/her first class, the retainer will be reimbursed;
– If the customer cancels between 30 days and 15 days before the day of his/her first class, the entire retainer (10%) will be lost;
– If the customer cancels less than 15 days before the day of his/her first class, payment for the entire class/camp/training course will be due, except if the customer has a medical certificate, in which case 50% will be due;
– No-show and/or renunciation are considered cancellation and the entire amount will be due;
– Classes that don’t take place because of the customer will not be reimbursed. A camp/training course duly started and then interrupted because of the customer will not be reimbursed.
The customer should inform us of any cancellation or any change in writing.

5. HASTEA SURF SCHOOL Liability

HASTEA SURF SCHOOL and its professional state-licensed instructors will take charge of the participants at the beginning of their class in Biarritz. As soon as the class is over, they are under the responsibility of their parents or legal representative.

HASTEA SURF SCHOOL’s civil liability regarding the participants should not apply outside these hours, within the timeframes described below. Before leaving their children at the Biarritz Surf Training structure, parents must check that the class is indeed taking place. We strongly advise participants not to leave anything (cash, watch, phone…) in the changing rooms. HASTEA SURF SCHOOL will not be responsible for any loss or theft on its premises.

HASTEA SURF SCHOOL will not be held responsible for any moral prejudice or accidental or willful damages caused by a third party during the activities. The agreement is limited to the services provided.

HASTEA SURF SCHOOL reserves the right to expel, without damages, any participant who does not comply with safety standards or who has an improper behavior. Any act violating the physical or moral integrity of one ore more participants and/or the instructor, and/or endangering the health or the life of other participants, of the instructor or their own, will be sanctioned.

6. insurance

HASTEA SURF SCHOOL certifies that it maintains a professional insurance covering the risks related to its activities. If the participant considers that the guarantees offered by the Biarritz Surf Training insurance are insufficient, it is the participant’s responsibility to subscribe to additional guarantees.

7. HASTEA SURF SCHOOL Commitment

Based on the package chosen by the participant, HASTEA SURF SCHOOL will offer services appropriate to the participant’s needs (quality of welcoming, teaching, coaching and safety). Similarly, the necessary equipment (wetsuit, board…) will be provided to the participant during his/her surf classes in Biarritz. Our classes are compliant with the quality charter of the French Association of Surf Schools (Association des Ecoles Françaises de Surf).

8. Participants’ Commitment

By enrolling with HASTEA SURF SCHOOL, adult surfers as well as minors and their parents and/or legal representative acknowledge and accept the risks related to surfing under normal conditions. The participant certifies that he/she is healthy, that he/she can swim 25 meters/80 feet and he/she is fit to surf. The participant accepts to comply with HASTEA SURF SCHOOL rules and safety instructions. He/She certifies having no medical or other contraindication to participate in the activity he/she enrolled for. In no circumstances will HASTEA SURF SCHOOL be held responsible for any physical or other consequences due to the participant omitting to declare any contraindication.

9. Transportation of participants

(If a vehicle is used as part of the services provided) HASTEA Surf School will comply with any applicable laws regarding the transportation of participants: appropriate driver’s license, vehicle insurance, maximum number of passengers, cleanliness and general condition of vehicles (compulsory inspections).

10. General Dispositions: Image and Publicity Rights

By enrolling, the participant grants Biarritz Surf Training the right to use any photo and/or video in which the participant appear shot during his/her class/camp/training course for publicity purposes, without any financial compensation. If the participant does not agree with this article, he/she must inform HASTEA SURF SCHOOL at the very beginning of his/her class/camp/training course.

11. Additional Conditions for the Club Package

Enrollment in the Club Package is reserved to locals who can sign up using the registration form provided for that purpose. The interested party shall take the 10 surf classes included in the Club Package (depending on the opening periods of the school) from April to June and from September to November, subject to availability.

Classes voluntarily not redeemed by the participant will not carry over to the following year and will not be reimbursed. A Club Package started and abandoned by the participant will not be reimbursed either.

In the event of any conflict of interpretation between the French and the English versions of the present Terms and Conditions, the original French version shall prevail.
